Terms of Service

Welcome to CALLUS, a men's health optimization app operated by Berserk Lab ("Berserk Lab," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the CALLUS web app, the CALLUS iOS companion app, and any related services (collectively, the "Service").

By creating an account, signing in, or otherwise using CALLUS, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

If you are accepting these Terms on behalf of a company or other entity, you represent that you have authority to do so and that the entity agrees to be bound by these Terms.

You must be at least 18 years old to use CALLUS. By creating an account, you represent and warrant that you are 18 or older. We do not knowingly permit anyone under 18 to create an account or use the Service.

You must also have the legal capacity to enter into a binding contract in your jurisdiction. If you do not, do not use the Service.

CALLUS is currently available primarily to users in the United States. If you access the Service from outside the US, you are responsible for compliance with any applicable local laws.

CALLUS is a health and fitness optimization tool. It helps you:

• Set and track personal health and performance goals.
• Log workouts, meals, sleep, and other lifestyle inputs.
• View AI-generated training, recovery, and supplement protocols.
• Have AI coach conversations for accountability and context.
• Optionally sync data from Apple HealthKit and wearables you own.

CALLUS is NOT a medical device. It is NOT a substitute for professional medical advice, diagnosis, or treatment. It is NOT a prescription service on its own. The AI coach inside CALLUS is a software tool — not a doctor, not a dietitian, and not a licensed healthcare provider.

CALLUS is provided for informational and educational purposes only.

We do not diagnose, treat, cure, or prevent any disease. Nothing inside the Service — protocols, coach messages, suggested supplements, workout plans, nutrition suggestions, or biomarker interpretations — constitutes medical advice.

You should always consult a licensed physician or other qualified healthcare provider before:

• Starting any new exercise, diet, fasting, or supplement regimen.
• Changing or discontinuing any prescribed medication.
• Acting on any biomarker interpretation or health recommendation shown in the app.
• Using any training protocol if you have a pre-existing condition, injury, or concern.

If you experience a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on CALLUS for emergency medical care or acute health decisions.

You use CALLUS at your own risk. You are solely responsible for any decisions you make based on content inside the app, and for the consequences of those decisions.

CALLUS may include an intake flow that routes interested users to independent, licensed telehealth providers for services such as hormone evaluation, peptide protocols, or TRT.

Important:

• Berserk Lab is NOT a healthcare provider and does NOT practice medicine.
• Berserk Lab does NOT issue prescriptions.
• Any clinical evaluation, diagnosis, prescription, and treatment decision is made solely by the licensed healthcare provider you are connected with, based on their independent medical judgment.
• The provider-patient relationship is between you and that licensed provider — not between you and Berserk Lab.
• Berserk Lab may receive a referral fee or other compensation from telehealth partners. This does not influence the provider's clinical decision-making.
• The provider may decline to prescribe for you, and that decision is theirs alone.

Any care you receive through a third-party provider is subject to that provider's separate terms, consents, and privacy policy, which you must review and agree to before treatment.

You are responsible for:

• Creating an account with accurate, current, and complete information.
• Keeping your email and password secure and confidential.
• All activity that happens under your account.
• Notifying us immediately at alex@proscalz.com if you suspect unauthorized access.

You may not share your account credentials, use another person's account, or create an account on behalf of someone else (including for a minor). One account per person.

When you use CALLUS, you agree to:

• Enter honest, accurate data about yourself. False data corrupts your protocol — and the app can't help you if you lie to it.
• Use the Service only for your own personal, non-commercial use.
• Consult a qualified professional before acting on anything the app suggests.
• Respect other users in any social features (community, crew, shared content).
• Comply with all applicable laws and regulations.

You agree NOT to:

• Use CALLUS to self-diagnose or self-treat a serious medical condition without a licensed provider.
• Use the Service for any illegal, fraudulent, or harmful purpose.
• Upload content that is illegal, hateful, harassing, defamatory, infringing, or obscene.
• Scrape, crawl, or use automated means to access the Service (except standard search indexing of public pages).
• Reverse-engineer, decompile, or attempt to extract source code from the app or our APIs.
• Circumvent, disable, or tamper with security features, rate limits, or access controls.
• Use CALLUS to build a competing product or service.
• Resell, sublicense, or commercially exploit the Service or its output.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Attempt to overwhelm, disrupt, or damage our infrastructure.

Berserk Lab owns the CALLUS app, including its code, design, brand, protocols, prompts, generated training plans, AI system messages, written content, trademarks, and logos. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

Nothing in these Terms transfers any of our intellectual property to you.

You own the raw data you create or sync — your workouts, meals, journal entries, biomarker values, and health-sync data. We describe how we handle that data in our Privacy Policy.

You keep ownership of any content you submit to CALLUS ("User Content") — including journal entries, voice transcripts, meal photos, workout logs, "fighting for" commitments, and messages to the AI coach.

To run the Service, you grant Berserk Lab a worldwide, royalty-free, non-exclusive license to host, store, transmit, copy, and process your User Content solely for the purpose of:

• Operating and personalizing the Service for you.
• Generating protocols, coach responses, and progress summaries.
• Backing up your data for disaster recovery.
• Anonymizing and aggregating data for product analytics (where the output cannot be tied back to you).

This license ends when you delete the specific content or your account — except where we must retain it to comply with law or for legitimate security purposes (see Privacy Policy, Section 10).

We do not use your User Content for advertising. We do not sell it. We do not train third-party AI models on it without your consent.

CALLUS V1 is free. We may introduce paid subscription tiers in the future. When we do:

• We will notify you by email and in-app before any charges begin.
• You will have the opportunity to actively opt into any paid tier; we will not automatically convert free accounts to paid without consent.
• Separate subscription terms will govern paid features, including pricing, billing cycle, cancellation, and refund policies.
• Apple App Store or Google Play Store subscriptions will also be subject to those platforms' terms.

Nothing in these Terms obligates you to pay for CALLUS.

CALLUS integrates with third-party services including Apple HealthKit, Supabase, Vercel, and Anthropic (see Privacy Policy, Section 7). Your use of those services is also governed by their own terms and policies, which we encourage you to read.

We are not responsible for the availability, accuracy, content, or practices of any third-party service. If a third-party integration fails or is discontinued, we will try to notify you and offer alternatives where possible.

You can delete your account at any time through Settings > Privacy > Delete My Data, or by emailing alex@proscalz.com. Deletion follows the retention timeline in our Privacy Policy.

We may suspend or terminate your account, with or without notice, if:

• You violate these Terms or our Privacy Policy.
• You use the Service in a way that causes legal or security risk.
• We are required to do so by law.
• We discontinue the Service entirely (we'll notify you and offer a data export).

On termination, your license to use the Service ends. Sections that by their nature should survive (IP, disclaimers, limitation of liability, dispute resolution) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERSERK LAB DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

• The Service will meet your specific health or fitness goals.
• Protocols, coach responses, or biomarker interpretations are appropriate for your specific medical situation.
• The Service will be available at all times or free from bugs.
• Any health outcome will result from using the Service.

Some jurisdictions do not allow the exclusion of certain warranties, in which case those exclusions may not apply to you, and you may have additional rights under applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IN NO EVENT WILL BERSERK LAB, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Because V1 is free, the practical effect is a $100 liability cap unless applicable law requires a higher amount.

Some jurisdictions do not allow these limitations, in which case they may not apply to you in full.

You agree to indemnify, defend, and hold harmless Berserk Lab, its affiliates, officers, directors, employees, and contractors from and against any third-party claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any law or the rights of a third party.
• Any content you submit through the Service.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

Please read this section carefully — it affects your legal rights.

Informal resolution first: before filing a claim, you agree to try to resolve the dispute informally by emailing alex@proscalz.com and giving us 30 days to respond.

Arbitration: if we can't resolve it informally, you and Berserk Lab agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through final and binding arbitration, conducted in Florida by a neutral arbitrator under the rules of the American Arbitration Association (AAA).

Class action waiver: you and Berserk Lab agree to resolve disputes only on an individual basis. You waive the right to bring or participate in any class, collective, or representative action.

Exceptions: either party may bring an individual claim in small-claims court, or seek injunctive relief for intellectual-property or security claims, without going to arbitration.

Opt-out: you may opt out of arbitration by emailing alex@proscalz.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email in the body.

If any portion of this section is found unenforceable, the remainder remains in effect, and any unenforceable portion will be severed.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. For any claim not subject to arbitration, the exclusive venue is the state and federal courts located in Florida, and you consent to personal jurisdiction there.

If you are a consumer residing outside the US, mandatory local consumer-protection laws may apply and may override portions of this section where required by law.

We may update these Terms from time to time. When we make a material change:

1. We will email every registered user at least 14 days before the change takes effect.
2. We will show an in-app banner on your next sign-in after the change.
3. We will update the "Effective Date" at the top of this page.

Your continued use of the Service after the effective date of an update means you accept the revised Terms. If you disagree with an update, stop using the Service and delete your account before it takes effect.

• Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and Berserk Lab regarding the Service.
• Severability: if any provision is found invalid or unenforceable, the rest remain in full force.
• No waiver: our failure to enforce any provision is not a waiver of the right to enforce it later.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: we are not liable for delays or failures caused by events outside our reasonable control.
• Language: English is the controlling language of these Terms.
• Headings: section headings are for reference only and do not affect interpretation.
